Terms and Conditions of Service

Please read these Terms carefully. Section 29 contains a binding arbitration agreement and class-action waiver, including a 30-day opt-out right.
Privacy First
We exist to help you turn food inspiration into recipes you can cook—not to invade your privacy. You control the photos and information you choose to provide, and we explain how they are collected, used, and protected in clear terms. If anything is unclear, contact us at info@kco.ai.
1. Introduction
Welcome to WhatDish, a mobile application and related service owned and operated by Kitchen Copilot Inc. ("WhatDish," "we," "us," or "our").
WhatDish uses artificial intelligence to turn photographs of prepared dishes, ingredients, or refrigerator contents into suggested recipes and meal ideas. Depending on the features available to you, WhatDish may also allow you to adjust recipes, save and organize them, create cookbooks, follow step-by-step cooking instructions, and share recipe links.
These Terms and Conditions of Service (the "Terms") govern your access to and use of the WhatDish mobile application, related websites, recipe links, software, artificial-intelligence features, subscriptions, content, and related services collectively referred to as the "Service."
By downloading, installing, accessing, purchasing, or using the Service, you acknowledge that you have read and agree to these Terms, our Privacy Policy, our Community Standards, and any additional rules or disclosures presented within the Service. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase a subscription. A person under 18 may use the Service only with the consent and active supervision of a parent or legal guardian who accepts these Terms and is responsible for that use. The Service is not directed to children under 13.
You must provide accurate account information, keep it current, safeguard your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account, except to the extent caused by our breach of applicable law. You may not sell, transfer, share, or commercially exploit your account or access credentials.
3. The WhatDish Service
WhatDish uses artificial intelligence to analyze a photograph of a prepared dish, ingredients, or the contents of a refrigerator and generate a suggested recipe or meal idea. Depending on the features available to you, the Service may also allow you to save and organize recipes, adjust portions or ingredients, use a step-by-step cooking view, create cookbooks, and share recipe links.
A generated recipe is an AI-created interpretation inspired by visible characteristics in the submitted image and other information you provide. It is not a verified copy of the photographed dish, the original chef's recipe, or the precise ingredients, quantities, nutrition, allergens, preparation methods, or food-safety practices used in that dish. Features identified as "coming soon," beta, experimental, or preview may be changed, delayed, restricted, or withdrawn.
4. Free Snaps
Eligible users may receive promotional AI recipe generations ("Free Snaps") at no charge, subject to the offer shown in the Service. You may receive additional Free Snaps when a friend you invite signs up for WhatDish through a supported referral method, subject to the eligibility, attribution, and limits disclosed in the app. Free Snaps have no cash value, are non-transferable, and may not be combined, resold, obtained through self-referral, or reproduced by creating multiple accounts.
A Free Snap is generally used when the Service successfully generates a recipe from your submitted image. A request that fails solely because of a verified WhatDish system error generally will not consume a Free Snap, although delays, low-quality images, unsupported content, or results you do not prefer do not necessarily constitute system errors. We may modify or discontinue a Free Snap offer prospectively, but doing so will not convert an existing paid subscription or impose a charge without your authorization. Additional Snaps may be available through promotions, subscriptions, or other access options disclosed in the Service.
5. Subscription Plan
For subscription access, the price, billing period, and number of Snaps included will be disclosed before purchase and form part of these Terms. Features and usage allowances may differ by platform, country, promotional offer, or billing channel.
A "Snap" means an AI processing request submitted through the Service to generate or materially regenerate a recipe or meal idea from an image. Ordinary edits that do not require a new image analysis may not count as a Snap, as indicated in the Service. We may use reasonable technical methods to measure usage and prevent duplicate, automated, fraudulent, or abusive requests.
If you use all Snaps included in your subscription, we may pause additional AI generations until the next billing period, offer additional Snaps if available, or ask you to contact us regarding unusually high or commercial usage. We will not impose an additional charge without your authorization. No subscription permits bots, scripts, account sharing, resale, bulk extraction, model training, competitive benchmarking, or operation of a commercial recipe-generation service unless we have agreed to it in writing.
6. Subscription Billing and Automatic Renewal
Subscriptions are billed in advance through the Apple App Store, Google Play, or another payment channel identified at purchase. Unless you cancel before the end of the current billing period, your subscription will automatically renew for the same period at the then-current price disclosed by the applicable billing provider, plus applicable taxes. Your payment method will be charged by that provider.
You can manage or cancel a subscription through the account settings of the platform through which you purchased it. Deleting the app or your WhatDish account does not automatically cancel a subscription. Cancellation stops future renewals but ordinarily does not provide a prorated refund for the current billing period, except as required by law or the billing provider's policies. Refund requests for App Store or Google Play purchases must generally be directed to the applicable store. We do not receive or store your complete payment-card number for in-app purchases.
7. Trials and Promotions
Any free or discounted trial is subject to the terms shown when offered. Unless you cancel before the trial ends, the trial may convert to a paid, automatically renewing subscription at the disclosed price. Eligibility may be limited and determined by us or the billing provider.
Promotional access, credits, and Free Snaps may expire as disclosed, may be withdrawn in cases of error, fraud, or abuse, and are not redeemable for money.
8. Your Photos and Other Content
"User Content" means photos, images, prompts, instructions, recipes, recipe edits, cookbook names, comments, feedback, and other material you submit, save, or share through the Service. You retain any ownership rights you have in your User Content.
You grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, analyze, transmit, display, and otherwise use User Content as reasonably necessary to operate, secure, personalize, maintain, and improve the Service; generate requested outputs; enable saving and sharing; enforce these Terms; and comply with law. This license ends when the relevant content is deleted from our active systems, subject to reasonable backup, legal, security, de-identification, and retention requirements.
You represent that you have all rights and permissions necessary to submit the User Content and permit this processing. Do not upload confidential information, trade secrets, payment data, government identifiers, images captured where photography is prohibited, or images of people who have not consented. Photos may contain metadata, including time or location information; device or app settings may allow you to limit such metadata.
9. Image Rights and Intellectual Property of Others
You may submit only images you created, are authorized to use, or may lawfully use. A photograph found online, in a cookbook, on a restaurant menu, or on social media may be protected by copyright, trademark, publicity, privacy, contract, or other rights even if it is publicly visible. You are responsible for determining whether you may upload, save, modify, or share it.
The Service is intended to generate a new recipe inspired by visual information. You must not use it to misrepresent an output as an authentic, confidential, or endorsed recipe of a restaurant, chef, brand, or other person. Recipe names, presentations, logos, trade dress, photographs, written instructions, and other elements may be protected. We may remove content or restrict access when we reasonably believe rights may be infringed.
10. AI Technology and Generated Recipes
The Service uses probabilistic artificial-intelligence and machine-learning systems supplied by us and third parties. AI output may be inaccurate, incomplete, inconsistent, offensive, or unsuitable; the same image may produce different results; and an output may resemble content produced for another user. We do not guarantee that the AI will identify a dish, ingredient, portion, cooking method, cuisine, nutritional value, or allergen correctly.
You must review and independently verify every generated recipe before relying on it. You are responsible for ingredient selection, substitutions, portion sizes, cooking temperatures, equipment, timing, supervision, and the decision to prepare, consume, publish, or share any output. Do not rely on the Service as the sole source of factual, professional, medical, dietary, nutritional, allergy, religious-diet, or food-safety information.
11. Food Safety, Allergies, and Dietary Restrictions
WhatDish is not a medical device, dietitian, nutritionist, physician, emergency service, or food-safety authority. Generated recipes may omit ingredients visible or invisible in a dish, fail to identify cross-contact risks, suggest an unsuitable substitution, or provide incorrect temperatures or cooking times. Restaurant dishes and packaged foods may contain ingredients not apparent from a photograph.
If you have a food allergy, intolerance, medical condition, pregnancy-related concern, or prescribed diet, consult an appropriate qualified professional and verify every ingredient, label, preparation surface, and cooking process. Follow authoritative food-safety guidance, use a food thermometer where appropriate, prevent cross-contamination, supervise children, and use kitchen tools and appliances safely. Never consume a food merely because the Service describes it as safe or compliant. If you believe you are experiencing an allergic reaction or medical emergency, contact emergency services immediately.
12. Nutrition Information
Any calorie, macronutrient, serving, or other nutrition information is an estimate based on assumed ingredients, quantities, databases, and preparation methods. Actual values vary. Nutrition information is provided for general informational purposes and is not medical advice or a substitute for a licensed professional's advice.
13. Sharing and Public Links
The Service may allow you to share a recipe by link or through a third-party service. Anyone with a public or forwarded link may be able to view, copy, or further share the associated content. Do not share content you wish to keep private. We do not control third-party platforms or what recipients do with shared content. Shared outputs remain subject to these Terms and applicable law.
14. Acceptable Use
You may use the Service only lawfully and in accordance with these Terms. You may not: (a) violate another person's intellectual-property, privacy, publicity, confidentiality, or contractual rights; (b) upload unlawful, exploitative, deceptive, threatening, hateful, sexually explicit, or malicious material; (c) submit images depicting child sexual abuse or exploitation; (d) probe, disrupt, overload, damage, or bypass the Service or its security and usage controls; (e) use bots, scraping, automation, or bulk requests without written authorization; (f) reverse engineer or attempt to extract source code, models, weights, prompts, or non-public data except where law expressly permits; (g) use the Service or output to train, test, or develop a competing model or service; (h) resell access or generated recipes as a WhatDish service; (i) impersonate others or misrepresent origin, endorsement, authenticity, or affiliation; or (j) use the Service in a manner that creates unreasonable cost, risk, or liability for us or others.
We may investigate suspected violations and may remove content, reject a request, reduce request frequency, suspend access, or terminate an account when reasonably necessary to protect users, third parties, the Service, or our legal rights.
15. Personal and Commercial Use
Unless a plan or written agreement expressly states otherwise, the Service is licensed for personal and household use. You may cook, save, and share recipes for ordinary non-commercial purposes. Use by restaurants, caterers, food publishers, agencies, creators operating at scale, recipe databases, meal-kit services, or other businesses may require our prior written approval or a commercial plan.
You remain responsible for reviewing generated output before any publication or commercial use and for obtaining all necessary rights, clearances, labels, disclosures, and regulatory approvals. We do not promise that output is exclusive, protectable, non-infringing, or fit for commercial exploitation.
16. Ownership of the Service
The Service, including its software, design, branding, interfaces, databases, text, graphics, and underlying technology, is owned by Kitchen Copilot Inc. or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on devices you own or control for its intended purpose.
WhatDish, Kitchen Copilot, associated logos, and related marks are trademarks or service marks of Kitchen Copilot Inc. Nothing in these Terms grants you a right to use them except as necessary to identify the Service.
17. Output and Feedback
As between you and us, and to the extent permitted by law, we do not claim ownership of a generated recipe solely because it was generated for you. Laws concerning ownership and protection of AI-generated material vary, and we make no representation that any output is eligible for copyright or other protection, unique, or free from third-party rights.
If you submit feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
18. Privacy and Data Processing
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including account data, device data, photographs, prompts, generated content, and usage information. By using the Service, you acknowledge those practices.
We may use User Content and interactions to provide, secure, evaluate, and improve the Service and its AI systems as described in the Privacy Policy and applicable in-product controls. We may use de-identified or aggregated information for analytics, research, safety, and service improvement. Where required by law, we will seek consent or provide an opt-out.
19. Third-Party Services
The Service may depend on third-party AI, cloud hosting, analytics, authentication, payment, image-processing, sharing, mapping, or communication services. Their services may be subject to separate terms and privacy practices. We are not responsible for third-party services, content, availability, or conduct, except where applicable law provides otherwise.
20. Beta and Experimental Features
Beta, preview, experimental, or newly released features may be incomplete, inaccurate, unavailable, or subject to additional limits. They are provided for evaluation and may be changed or discontinued at any time. Your feedback and usage information may be used to evaluate and improve them.
21. Updates and Changes to the Service
We may update the app, models, interfaces, supported devices, features, or technical requirements and may discontinue features when reasonably necessary. Some updates may be required to continue using the Service. We will not materially reduce a prepaid core subscription benefit during the paid period without an appropriate remedy where required by law.
22. Suspension and Termination
You may stop using the Service at any time and may request account deletion through available account tools or by contacting us. Subscription cancellation must be completed separately through the billing provider.
We may suspend or terminate access, remove content, or decline renewal if you materially or repeatedly violate these Terms, create security or legal risk, misuse the Service, fail to pay, or if continued operation becomes unlawful or impracticable. When appropriate, we will provide notice and an opportunity to cure. Upon termination, your license ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, limitations, indemnity, dispute terms, and miscellaneous provisions—will survive.
23. Data After Termination
After account deletion or termination, we will delete or de-identify personal information in accordance with our Privacy Policy, subject to reasonable periods needed for backups, fraud prevention, security, legal compliance, dispute resolution, enforcement, and records of transactions. Content already shared with others may remain in their possession or on third-party services.
24. Service Availability and Force Majeure
We do not guarantee uninterrupted, secure, or error-free operation. Access may be affected by maintenance, demand, network failure, third-party providers, device compatibility, cyber incidents, natural disasters, labor disputes, government action, war, epidemics, or other events beyond our reasonable control. We are not liable for delay or failure caused by such events, subject to applicable law.
25. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE AND OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SAFETY, AND RESULTS.
WE DO NOT WARRANT THAT A GENERATED RECIPE WILL RECREATE THE PHOTOGRAPHED DISH; IDENTIFY ALL INGREDIENTS OR ALLERGENS; BE NUTRITIONALLY, MEDICALLY, CULTURALLY, OR RELIGIOUSLY APPROPRIATE; BE SAFE TO PREPARE OR CONSUME; OR MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
26. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITCHEN COPILOT INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; OR PERSONAL OR PROPERTY LOSS ARISING FROM RELIANCE ON AI OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR OUR FRAUD, WILLFUL MISCONDUCT, OR OTHER MATTERS EXCLUDED BY APPLICABLE LAW.
27. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Kitchen Copilot Inc. and its affiliates, officers, directors, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from your User Content, your unlawful or commercial use of the Service, your violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from our own breach, negligence, or willful misconduct. We may control the defense of an indemnified claim, and you will reasonably cooperate.
28. Informal Dispute Resolution
Before initiating arbitration or a court proceeding, the complaining party must send a written notice describing the dispute and requested relief. Notices to us must be sent to legal@kitchencopilot.com and to the mailing address in Section 34. We will attempt in good faith to resolve the dispute for at least 30 days after receipt. This requirement does not prevent either party from seeking urgent injunctive relief or bringing an eligible claim in small-claims court.
29. Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. Except for eligible small-claims matters, intellectual-property disputes, or requests for urgent injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this provision. Arbitration may occur by video, telephone, written submissions, or in Mecklenburg County, North Carolina, unless the applicable rules or law require another location.
YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. The arbitrator may award the same individual relief a court could award but may not combine claims without all parties' consent.
You may opt out of this arbitration provision by emailing legal@kitchencopilot.com within 30 days after first accepting these Terms. Your notice must include your full name, the email associated with your account, and a clear statement that you opt out of arbitration. Opting out will not affect other provisions. If applicable law prohibits a part of this Section, that part will be severed only to the minimum extent necessary.
30. Governing Law and Courts
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 29. If a dispute is not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina. Mandatory consumer protections of your place of residence remain unaffected.
31. Apple App Store Terms
If you downloaded the app from Apple's App Store, these Terms are between you and Kitchen Copilot Inc., not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its policies; to the maximum extent permitted by law, Apple has no other warranty obligation. Kitchen Copilot Inc., not Apple, is responsible for addressing claims relating to the app, including product-liability, legal-compliance, and intellectual-property claims.
Your license is limited to use on Apple-branded products you own or control as permitted by the Apple Media Services Terms and applicable Family Sharing or volume-purchase rules. You represent that you are not located in a country subject to a U.S. government embargo and are not on a U.S. government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.
32. Google Play and Other App Stores
If you obtained the app through Google Play or another app store, your use is also subject to that store's applicable terms. These Terms are between you and Kitchen Copilot Inc.; the store provider is not responsible for the Service except as required by law or its own terms. Billing, cancellation, and refund administration may be handled by the store provider.
33. Changes to These Terms
We may update these Terms to reflect changes in law, technology, the Service, pricing structures, or business practices. If a change is material, we will provide reasonable notice through the app, by email, or by another appropriate method before it takes effect, except where immediate changes are necessary for legal, security, or abuse-prevention reasons. The "Effective Date" will identify the current version. Your continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, you must stop using the Service and cancel any renewal.

35. Miscellaneous
These Terms, the Privacy Policy, and any purchase-screen or feature-specific terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. No agency, partnership, employment, or joint venture is created.
Headings are for convenience only. "Including" means "including without limitation." Electronic communications and records satisfy legal writing requirements. Except for Apple's beneficiary status described above, these Terms do not create third-party beneficiary rights.
